..hi Bradley Harris and Daryl O, this topic interests me, since I’m involved in something similar
….so, my backstory is that after adjourning lots of ‘charges’, over approx 2 yrs, a Mag got a conviction on May 29th, and I (believing he made errors in law / procedure) pushed the conviction into a supreme crt judicial review….it’s at the stage where I need to make an “interlocutory motion” in supreme crt to have the conviction “stayed”
….seems that this 1980 Act (from an earlier one in England, and absorbed into Victorian Statutes in 1980) allows me to argue that “all fines and forfitures are illegal until conviction”
….hence with the Mag crt decision in dispute, there is reason/are grounds for “staying the order”
